Subject: Privacy policy issued by Motovario S.p.A. pursuant to art. 13 of Leg. Decree 196/2003

Whereas

  • 1) as part of your browsing this website, compiling the downloadable forms, making preliminary contacts and for market surveys and research, including the establishment of business relations, our Company will need to collect and process your personal details;

  • 2) for the purpose of clarity, we henceforth specify the following terms and their definition, as stated by Leg. Decree 196/2003: Data processing: any transaction, including ones without the aid of electronic instruments, that concerns the collection, registration, organization, storage, consultation, elaboration, modification, selection, extraction, comparison, use, interconnection, restriction, disclosure, communication, cancellation and destruction of data; Personal details: any information referring to an individual who is identified or can (even indirectly) be identified by an association to any other piece of information, including a personal ID number;

provided all of the above, pursuant to article 13 of Leg. Decree 196/2003 (Law on Privacy), we hereby inform you that your personal details will be collected and processed by the Company issuing this statement, in compliance with the following:

  • a) general aims: your data will be processed to satisfy your requests, in order to ensure all bureaucratic, commercial, accounting, fiscal and technical obligations are fulfilled, and to carry out all Company activities that are mandatory by Law or that at any rate strictly concern the business relation(s) entered with the applicant;

  • b) "direct marketing" aims: your (non-confidential) details may also be used, only and exclusively if the Company receives your free, optional, specific and explicit consent (at any time revocable) to send advertising material/newsletters by letter mail, e-mail, fax, text messages or the like; please be informed that you are entitled to at any time and without added cost, object to the processing of your data for said aims, even after you have granted consent thereto;

  • c) data storage term: your personal details will be kept on file by our Company in compliance with the limit terms admissible by current law. Detailed instructions are imparted to subjects to whom your data may possibly be disclosed (see below), for them to also comply with the aforesaid storage term;

  • d) Processing method: your personal details will be processed both under the form of printed documents and in electronic/digital format, in full compliance with the provisions of law, according to principles of lawfulness and fairness and so as to protect your confidentiality;

  • e) optional consent: disclosure of your details is optional and not mandatory;

  • f) consequences of denied consent: your refusal to provide the data or your full opposition to its processing for the aims described under point a) may, however, be an impediment to the Company's ability to satisfy certain of your requests; denying consent to use your data for the aims described under point b) will not, instead, entail any consequence with regard to the provision of benefits tied to our sales offers or to mutual business relations;

  • g) subjects or categories thereof to whom the data may be disclosed or distributed: the data may only be disclosed to ensure full compliance with legal obligations and as part of activities closely tied to existent business relations, to subjects such as agents and representatives, consultants and the like, of whose services our Company is a beneficiary. The data will in no case be distributed;

  • h) Data controller and processor(s): your personal details will only and exclusively be processed by a closed circle of Company employees in the administrative, marketing, CED and sales offices, purposely authorized thereto;

  • i) rights of the disclosing subject: you are entitled to all the rights decreed by art. 7 (please refer to its full content for details);

  • j) Data controller: the Data Controller is Motovario S.p.A., with legal office in Milan, Via P. Verri no. 8, in the person of its pro tempore Legal Representative;

  • k) Data Processor(s): the "Data Processor" is Mr. Juri Torreggiani; the "Contact Person" is Mrs. Annachiara Grasselli. Both can be contacted at their office in Reggio Emilia, Via Piccard no. 16/G, tel. (+39) 0522-382811, fax: (+39) 0522.387996: you may request clarifications or information to the aforesaid subjects. The full and updated list of Data Processor(s) can be downloaded and read on the Company's website and/or in its printed version kept on file at the Company's legal office. Further elements and indications may be added to this Privacy Policy in the future, verbally or in writing, in order to better satisfy your demand to be fully informed on your "Privacy" rights and to adapt the Policy to the evolving legislation.

1. the subject has first carefully read and understood all the parts of this Privacy Policy, pursuant to art. 13 of Leg. Decree 196/2003;
2. the subject is perfectly aware of his/her rights pursuant to art. 7 of Leg. Decree 196/2003;
3. the subject declares to be acting in total freedom and not under any form of psychological pressure and/or influence; provided all of the above

the subject grants his/her broadest consent
to allow the Company to process his/her personal details, public and confidential, that are required to pursue the aims described under point a) of the aforementioned Privacy Policy.

The undersigned, by placing his/her signature below, also grants his/her specific and explicit consent for the Company to process the data for the aims described under point b) of the Policy, and thereby agrees to receive advertising material/newsletters, such as leaflets, invitations, offers by letter mail, e-mail fax, text message or the like, sent by the Data Controller. It is henceforth understood that it is a precise right of the undersigned to revoke his/her consent at any time, contacting the Contact Person to exercise such right.
